These Terms & Conditions ("Terms") govern your access to and use of Book Launch Ready (the "Service"), operated by Yvette Farkas ("we", "us", "our"). By creating an account, purchasing access, or otherwise using the Service, you agree to these Terms.

1. Who you are contracting with

The Service is provided by Yvette Farkas, an individual sole proprietor operating Book Launch Ready. References to "we" or "us" in these Terms refer to Yvette Farkas.

2. The Service

Book Launch Ready is a guided, step-by-step web tool that helps authors prepare a finished manuscript for self-publication on platforms such as Amazon KDP and IngramSpark. It generates back cover copy briefs, keyword and category research, KDP setup guidance, launch checklists, and related publishing assets. The Service does not write, edit, or design your manuscript, does not produce your cover artwork, and does not operate your KDP account on your behalf.

3. Eligibility and account responsibility

You must be of legal age in your jurisdiction and have authority to bind any organization on whose behalf you use the Service. You are responsible for the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it current.

You retain ownership of the manuscripts, author bios, photos, and other materials you upload ("Your Content"). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate the Service for you. You represent that you have all rights necessary to provide Your Content and that it does not infringe any third-party rights.

6. Our intellectual property

The Service — including its software, templates, frameworks, checklists, written materials, branding, and the proprietary publishing methodology — is owned by Yvette Farkas and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own publishing projects under the plan you have purchased.

7. Service level

We work hard to keep the Service reliable but do not guarantee that it will be uninterrupted, error-free, or meet every requirement. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Payments and merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to our Refund Policy.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may export any Launch Kit PDFs or generated assets for 30 days after termination, after which we may delete account data in accordance with our Privacy Notice.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for indirect, consequential, special, or incidental damages, including loss of profits, loss of data, or loss of goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion would be unlawful.

11. Indemnity

You will indemnify and hold us harmless from any third-party claim arising out of Your Content, your unlawful use of the Service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflicts of law principles. The courts of Ontario have exclusive jurisdiction over any dispute arising under these Terms, subject to mandatory consumer protection laws of your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or via the Service. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
